NBA VP Flays AKHA On Transition Committee

A lawyer and National Ist Vice President of the Nigeria Bar Association, Barr. Francis Ekwere has criticized the AkwaIbom State House of Assembly for approving the constitution of transition committees in the thirty-one Local Government Councils.

In a letter addressed to the State Governor titled ‘ Re: Constitution of Transition Committees To Run and Administer Local Government Areas In AkwaIbom State’ described the creation of Transition Committees as unconstitutionality citing Section 7(1) of the Constitution of the Federal Republic of Nigeria which he said provides and guarantees that “only democratically elected councils or persons shall administer or run the affairs of Local governments or councils. It doesn't admit of transition committees or caretaker committees. So to set up transition committees to administer or run local governments is an illegality. It's unconstitutional. We have several judicial decisions to that effect. Local governments by the constitution must be run by democratically elected officials not persons appointed by the Governor”.

Barr Ekwere who is a former Chairman, NBA Eket branch,2006-2008, National 1st Assistant Secretary, described it as “legally wrong, null and void. It's a flagrant act of lawlessness and unconstitutional act that have unimaginable implications-impeachment”.

He notified the State Governor that should he plan to inaugurate or swear-in the Transition Committees, they shall approach a Court of competent jurisdiction to seek an order to nullify such appointments

Transition Committees: AKHA Increase Members…Extends Tenure

Following the expiration of the tenure of the present Local Government Administration in Akwa Ibom State, the Akwa Ibom State House of Assembly during plenary passed into law, an amendment of the Local Government (Administration) Law 2007.

Presenting the bill before the House, the member representing Etinan State Constituency Barr. Aniefiok Dennis moved for an amendment through the deleting of sub-paragraph (b) of section 4(3) and inserting a new sub-paragraph (b) for the appointment of a Transition Committee of not more than nine (9) members from six (6) previously to administer the affairs of the Council for six (6) month period, instead of three (3) months in the first amendment but not exceeding twelve (12) months in the aggregate within which period election shall be held.

Speaking on the bill, the Leader of the house and member representing Oruk Anam State Constituency, Elder Udo Kieran Akpan said the amendment is within the confines of the House legislative capabilities as well as in line with the expiration of the Local Government tenure. He noted that the bill which is timely would check any vacuum especially in the third tier of government which happens to be the pillar of governance.

Also lending their voices, members for Essien Udim, Obong Nse Ntuen and that of Nsit Atai Mr. Mark Eset while calling for accelerated hearing, noted that increasing the number of Transition Committee members to nine is commendable since it will touch some areas which have not yet benefitted.

The motion to pass the amendment was moved by the House Leader, Elder Udo Kierian Akpan while the member representing Mkpat Enin Engr. Otobong Ndem seconded the motion.

Accordingly, the Speaker, ElderAniekanUko directed the Clerk of the House, Mrs. ManduUmoren to communicate the position of the House to the Executive Governor for implementation.
