NBA VP Flays AKHA On Transition Committee

A lawyer and National Ist Vice President of the Nigeria Bar Association, Barr. Francis Ekwere has criticized the AkwaIbom State House of Assembly for approving the constitution of transition committees in the thirty-one Local Government Councils.

In a letter addressed to the State Governor titled ‘ Re: Constitution of Transition Committees To Run and Administer Local Government Areas In AkwaIbom State’ described the creation of Transition Committees as unconstitutionality citing Section 7(1) of the Constitution of the Federal Republic of Nigeria which he said provides and guarantees that “only democratically elected councils or persons shall administer or run the affairs of Local governments or councils. It doesn't admit of transition committees or caretaker committees. So to set up transition committees to administer or run local governments is an illegality. It's unconstitutional. We have several judicial decisions to that effect. Local governments by the constitution must be run by democratically elected officials not persons appointed by the Governor”.

Barr Ekwere who is a former Chairman, NBA Eket branch,2006-2008, National 1st Assistant Secretary, described it as “legally wrong, null and void. It's a flagrant act of lawlessness and unconstitutional act that have unimaginable implications-impeachment”.

He notified the State Governor that should he plan to inaugurate or swear-in the Transition Committees, they shall approach a Court of competent jurisdiction to seek an order to nullify such appointments
